I am lately having a lot of questions from various people asking if downgrade from EB2 to EB3 is recommended for Indian nationals with an EB2 approved I-140 petition. At this point we do not recommend the downgrade but watch out this space for more updates as the visa bulletins are released.
Just a reminder to ensure that the check for $1,410 in favor of Department of Homeland Security is attached for all premium processing cases filed on or after October 1, 2018. Previously the fees for premium processing was $1225.
The new premium processing filing fee increase will become effective for all requests mailed, postmarked or otherwise filed on or after October 1, 2018.
Remember that Premium Processing is still available for Employment-Based (EB2/EB3) petitions and I-129 H-1B petitions filed as “Continuation of Previously Approved Employment without Change”.
Any potential and/or intending immigrant such as ones with approved immigrant petition (such as I-140 etc) should ensure that they do not become a Public Charge. The definition and interpretation of “Public Charge” is currently being expanded. “PUBLIC CHARGE” IS A TERM USED by U.S. immigration officials to refer to a person who is considered primarily dependent on the government for subsistence, as demonstrated by either receipt of public cash assistance for income maintenance or institutionalization for long-term care at government expense.

DHS has informed the federal court on Sep 21, 2018, that they expect the proposed H4 EAD withdrawal rule to be published for public comments within 3 months. Based on the current projections this could potentially be in the first week of Jan 2019 or late Dec 2018.Read More »
USCIS is currently extending grace period for prior versions of G-28 till November 19, 2018. Ensure that only the version dated September 17, 2018 is used after November 19, 2018. G-28 is the form used for all attorney representations in immigration filings.
